1. Acceptance
By registering for or using YKRAFT ("the Service"), provided by YKRAFT — currently an
individual undertaking, registering as a business in Poland (EU) ("YKRAFT", "we",
"us") — you ("you", "the Customer") agree to these Terms of Service. If you are agreeing on
behalf of an organisation, you confirm you are authorised to bind it.
YKRAFT is pre-launch and does not take payments yet; the paid terms below (fees,
billing) apply only once paid plans are offered, after YKRAFT is registered.
2. The Service
YKRAFT is a self-hosted operations platform — documentation, ticketing, forms, file
management, remote device management, automation, alerting, AI search, and an extensible
plugin system. YKRAFT runs and maintains the application layer; the application is
proprietary and closed-source, licensed to you for use under these Terms and **not
sold or transferred** to you.
We may add, change, or remove features over time. We will not make a change that
materially and adversely degrades a core feature you rely on without reasonable notice.
3. Your Data and Our Role (Hybrid Model)
YKRAFT runs on a deliberate hybrid model:
- You own the data layer. Your operational data lives in your PostgreSQL
database and your S3-compatible storage, which you own and control.
- YKRAFT never persists your operational data on its servers. The application
processes it transiently in memory to provide the Service — to render your pages,
run your tickets, manage your devices, and so on — exactly like any application you
would self-host. It is not written to YKRAFT-controlled storage.
- For that operational data, you are the data controller and YKRAFT acts only as a
processor on your instructions (see Section 5).
- Backups of your data layer are your responsibility. Because your database and
storage are yours, you control and are responsible for their backup, retention, and
recovery, unless we agree otherwise in writing.
- You can export or move providers at any time. You are never locked in.
Personal data that YKRAFT itself controls (your account, billing, support, leads) is
handled per our Privacy Policy.
4. Your Responsibilities
You agree to:
- Provide accurate registration and billing information and keep it current.
- Keep your credentials and access secure, and be responsible for activity under your
account.
- Use the Service lawfully and not to infringe rights, distribute malware, attack
others' systems, or violate applicable law.
- Maintain and secure the database, storage, and any device-management server (e.g.
MeshCentral) that you operate in connection with the Service.
5. Data You Collect From Others (Processor Terms)
If you use YKRAFT — including its forms — to collect or process personal data of your own
users or clients:
- You are the data controller for that data and are solely responsible for having a
lawful basis, providing notices, honouring data-subject rights, and complying with the
GDPR and other applicable laws.
- YKRAFT acts only as your data processor, processing that data on your documented
instructions and only to provide the Service. We do not use it for our own purposes.
- These Terms incorporate, and where required we will sign, a separate **Data Processing
Agreement** governing security measures, sub-processors, and assistance with
data-subject requests. A Data Processing Agreement is available on request at
legal@ykraft.tech.
6. Intellectual Property
The Service, the application, and all related software and materials are owned by YKRAFT
and protected by intellectual-property law. You receive a **limited, non-exclusive,
non-transferable right to use the Service** during your subscription. You may not copy,
reverse-engineer, resell, or create derivative works of the application except as the law
expressly permits. You retain all rights to your data and content.
7. Fees and Payment
- YKRAFT is currently in pre-launch and is free to use; no payments are taken yet.
- Any future fees, billing cycle, and free period will be agreed with you **in writing
before a paid plan begins**, and these Terms will be updated accordingly.
- Where paid plans are later offered, payments will be processed by Stripe, and fees
will be stated as inclusive or exclusive of VAT/taxes at that time.
8. Term, Termination, and Data Export
- The Terms apply for as long as you use the Service. You may cancel at any time.
- We may suspend or terminate your account for a material breach of these Terms
(including unlawful use or non-payment), where practical after notice and a chance to
cure.
- On termination, your right to use the application ends. Because your operational data
lives in your own database and storage, it remains with you; YKRAFT will, on
request and within a reasonable period, stop processing it and remove any residual
access. Account/billing data is retained per the Privacy Policy and applicable law.
9. Service Availability
We work to keep the Service available and reliable but, unless a separate service-level
agreement is signed, the Service is provided without a guaranteed uptime commitment. We
may perform maintenance and will give reasonable notice of planned downtime where
practical.
10. Disclaimer of Warranties
Except as expressly stated and to the extent permitted by law, the Service is provided
"as is" and "as available", without warranties of any kind, express or implied,
including fitness for a particular purpose, merchantability, and non-infringement. This
does not exclude any warranty or right that cannot be excluded under applicable law
(including mandatory consumer-protection law).
11. Limitation of Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental,
special, or consequential damages, or for lost profits or data. YKRAFT's total aggregate
liability arising out of or relating to the Service is limited to the total fees you paid
to YKRAFT in the 12 months before the claim — or, while the Service is provided free of
charge, EUR 100. Nothing in these Terms limits
liability that cannot be limited by law (e.g. for death or personal injury caused by
negligence, fraud, or wilful misconduct).
12. Indemnification
You will defend and indemnify YKRAFT against third-party claims arising from your unlawful
use of the Service or from data you collect or process using the Service in breach of
these Terms or applicable law.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the latest
version, and we will notify you of material changes by email or in-app. Continued use
after a change takes effect constitutes acceptance.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Poland, and the courts of Poland have
exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights in
your country of residence.
